DMCA
Last updated:
Kin Print respects the work of artists, photographers, illustrators and writers, and we expect the same from everyone who uses our site. This page explains how to tell us about material on kinprint.shop, or a product we produced, that you believe infringes your copyright, and how a customer or designer can respond if they believe a notice was sent in error. It follows the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA). For trademarks, brand names and other intellectual property, see our Intellectual Property Policy.
Copyright notices at a glance
- Send notices to: support@kinprint.shop with the subject “DMCA notice”.
- Postal address: Kin Print, 1714 Wasabi Way, Gilroy, CA 95020, US.
- Acknowledgement: within 24 hours on business days.
- Action: material that is the subject of a complete notice is removed or disabled promptly while we review it.
- Counter-notices: accepted from the person whose material was removed.
- Repeat infringers: accounts may be closed.
1. What this policy covers
Kin Print sells personalised family gifts. Two kinds of material appear in connection with our shop:
- Our own site content: product designs, illustrations, photos, text and graphics published on kinprint.shop.
- Customer content: names, short phrases and photos that customers send us so we can personalise an item for their family. Customer photos are never published on our website; they are used only to produce the ordered item and deleted 30 days after delivery.
If you believe any of this material copies your original work without permission, this policy tells you how to reach us and what happens next. We take every notice seriously and handle it promptly and fairly.
2. Before you send a notice
Copyright protects original creative expression, such as a photograph, illustration, piece of writing or graphic design. It does not protect short common phrases (“Best Mom Ever”), names, dates, simple shapes, or ideas. Some uses of copyrighted material may also be allowed as fair use. Please consider whether the material is actually yours and whether its use is authorised before sending a notice. Sending a notice you know to be false can make you liable for damages under US law.
If your concern is a logo, brand name or character name rather than a copyrighted image or text, our Intellectual Property Policy describes the better route.
3. How to send a copyright notice
Email support@kinprint.shop with the subject line “DMCA notice”, or post it to Kin Print, 1714 Wasabi Way, Gilroy, CA 95020, US. Email is faster. Your notice must include all of the following:
- Your physical or electronic signature (typing your full legal name is acceptable in an email).
- A description of the copyrighted work you believe has been infringed, for example a link to where your original photo or illustration is published.
- The exact location of the material on our site, such as the full product page URL and, if helpful, a screenshot showing which part is infringing.
- Your contact details: name, postal address, phone number if you wish, and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
If you are acting for a company or an artist, please say so and describe your authority.
| Required element | Example of what to send | Why we need it |
|---|---|---|
| Signature | “/s/ Jordan Lee” at the end of the email | Required by the DMCA to make the notice valid |
| Original work | Link to your portfolio page showing the illustration | Lets us compare the two works |
| Location on our site | Full product page URL plus a screenshot | Lets us find and remove the exact material |
| Contact details | Name, postal address, email | Lets us reply and forward a counter-notice |
| Good-faith statement | “I have a good-faith belief that the use is not authorised” | Required by the DMCA |
| Accuracy statement | “Under penalty of perjury, I am the owner or authorised to act” | Required by the DMCA |
4. What happens after we receive a notice
- We acknowledge your notice within 24 hours on business days.
- We check that the notice contains all the required elements. If something is missing, we tell you what to add.
- When the notice is complete, we promptly remove or disable access to the material identified and stop producing items that use it.
- If the material came from a designer or partner, we notify them and send them a copy of the notice, including your contact details, so they can respond.
- We confirm to you by email what action we took.
Where a notice concerns a personalised item already produced for a customer using a photo they supplied, we contact the customer, explain the concern and, where appropriate, cancel any pending production of the same content. We do not publish customer photos, so in most cases there is nothing on the website to remove.
5. Counter-notices
If material you provided was removed and you believe that happened because of a mistake or misidentification, you can send a counter-notice to the same address with the subject “DMCA counter-notice”. It must include:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Kin Print may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a complete counter-notice, we forward a copy to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have filed a court action to stop the infringement, we may restore the material.
6. Repeat infringers
We may close the accounts of, and refuse future orders from, customers or partners who repeatedly submit content that infringes the rights of others, in appropriate circumstances.
7. Photos customers send us
Most of the photos we receive are family snapshots taken by the customer or a relative. Some are professional portraits, school photos or wedding photos that belong to the photographer. Before you send us a professional photo for a canvas, ornament or mug, please check that your agreement with the photographer allows personal prints; many do, some do not. By sending a photo, you confirm you have the right to use it, as set out in our Terms of Service. If a photographer contacts us about an order, we follow the process on this page.
8. Our own designs
The illustrations, layouts and text on Kin Print products and pages are created for Kin Print or used with permission. If you would like to use any of our content, please ask first by email. If you find our designs or product photos being used by another shop without permission, we would be grateful if you let us know.
9. Misuse of the notice process
Under section 512(f) of the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and legal fees. Please send only notices you believe are accurate. We may disregard notices that are clearly abusive or that attempt to remove content for reasons unrelated to copyright, such as a competitor’s complaint about pricing.
10. Privacy of notices
The information in a notice or counter-notice is used to process it. We may share it with the person whose material is affected, and we may keep a copy as a record of our response. We do not publish notices on our site. Read our Privacy Policy for how we handle personal information.
11. Timelines in one place
| Step | Our timing |
|---|---|
| Acknowledging a notice | Within 24 hours on business days |
| Removing material from a complete notice | Promptly after we confirm the notice is complete |
| Forwarding a counter-notice | Promptly after we receive a complete counter-notice |
| Restoring material after a counter-notice | After 10 to 14 business days if no court action is reported |
12. Common questions about copyright and personalised gifts
Can I put a song lyric on a canvas for our anniversary?
Most song lyrics are protected by copyright, and printing them on a product usually needs the songwriter’s or publisher’s permission. We may decline lyric requests for that reason. A line you wrote yourself about the song, the song’s title with your names, or the date you first danced to it are good alternatives.
Can I use a school or studio portrait of my grandchild?
That depends on the photographer’s terms. Many school and studio packages include a print release for personal use; some do not. If you are unsure, ask the photographer or choose a family snapshot instead. If a photographer later tells us an order used their work without permission, we follow the notice process above.
Can I send a drawing my child made?
Yes. A drawing made by your own child for the family is one of the loveliest things to put on a mug or ornament, and the family has every right to use it for a personal gift.
Someone is selling Kin Print designs elsewhere. What should I do?
Please send us the link. We review it and contact the seller or the platform where appropriate. Your message helps protect the work of the designers we work with.
Can I put a famous quote on a gift?
Very old quotes and proverbs are usually free to use, while recent quotes from books, films or speeches may be protected. When in doubt, choose words of your own; a sentence in your own voice almost always means more to the person receiving the gift.
